菸害防制法新制－校園全面禁菸規範因應措施

一、「菸害防制法」已自112年3月22日起修正施行，該法條文涉大專校院之重點如下：

(一)校園全面禁菸

1、增列大專校院為全面禁菸場所、應於出入口設置禁菸標示且不得供應與吸菸有關之器物。

2、有人於禁菸場所吸菸，場所負責人或從業人員（教職員工）應予勸阻，在場之其他人亦得予勸阻。

3、禁菸場所未於所有入口處設置明顯禁菸標示，處負責人1萬元以上5萬元以下罰鍰，於禁菸場所吸菸者，處其2,000元以上1萬元以下罰鍰。

(二)提高禁止吸菸年齡

1、禁菸年齡由18歲提高至20歲。

2、任何人不得供應菸品、指定菸品（含加熱菸）必要之組合元件予未滿20歲之人。

3、未滿20歲違規吸菸者，應接受戒菸教育。

(三)全面禁止類菸品（含電子煙）、加強管制指定菸品（含加菸）

1、類菸品（含電子煙）採全面禁止，任何人不得使用、製造、輸入、販買、供應、展示或廣告。

2、嚴格管制指定菸品（含加熱菸），任何人不得使用未經主管機關審查通過之指定菸品，亦不得製造、輸入、販賣、供應、展示或廣告未經主管機關審查通過之指定菸品或其必要之組合元件。

二、違反菸害防制法檢舉

(一)發現違反菸害防制法情事，如(禁菸環境內吸菸、未滿20歲吸菸、販賣菸品予未滿20歲者、菸品廣告、菸品促銷....等)，歡迎逕向衛生局檢舉。

檢舉時提供違規吸菸者的基本資料，例如：姓名、身分證字號等；如無法取得 上述資料也可以檢舉，只要提供違規的證明，例如：照片、影片，並說明拍照或錄影的時間、地點，將資料寄送到當地衛生局，衛生局便會依事證告發或實地稽查輔導。菸害檢舉信箱：南投縣南投市復興路6號  南投縣政府衛生局

(四)校內違規吸菸處理：遇有違規情形可柔性勸導或檢具相關事證(人事時地物-如姓名、ID、吸菸影像)等資料交衛生局予以處分，或通報校安中心0932576184/駐衛警察隊#2458協處。

obacco Hazards Prevention Act: Smoke-Free Campus Policy

In accordance with the amended Tobacco Hazards Prevention Act, effective March 22, 2023, the following regulations apply to all colleges and universities in Taiwan.

Smoke-Free Campus

1.All college and university campuses are designated as smoke-free areas. Smoking is prohibited throughout the entire campus.

2.No Smoking signs are posted at all campus entrances. Smoking-related items, such as ashtrays, are not provided on campus.

3.If anyone is found smoking in a smoke-free area, faculty, staff, and other personnel are required to advise the individual to stop. Others present are also encouraged to remind the person to comply with the regulations.

4.Individuals who smoke in a smoke-free area are subject to a fine of NT$2,000–10,000. Institutions that fail to display the required No Smoking signs may be fined NT$10,000–50,000.

Minimum Legal Age for Smoking

1.The minimum legal age for smoking in Taiwan is 20 years.

2.It is prohibited to sell or provide tobacco products or designated tobacco products (including heated tobacco products) and their essential components to anyone under the age of 20.

3.Individuals under the age of 20 who violate the law by smoking are required to attend smoking cessation education.

E-cigarettes and Heated Tobacco Products

1.E-cigarettes and other tobacco imitation products are prohibited. Their use, manufacture, importation, sale, supply, display, and advertising are prohibited by law.

2.Heated tobacco products are subject to strict government regulation. Only products approved by the competent authority may be legally marketed. The manufacture, importation, sale, supply, display, advertising, or use of unapproved heated tobacco products or their essential components is prohibited.

Reporting Violations

If you observe any violations of the Tobacco Hazards Prevention Act, such as:

Smoking in smoke-free areas;Smoking by persons under the age of 20;Selling or supplying tobacco products to persons under the age of 20; orIllegal advertising or promotion of tobacco products, e-cigarettes, or heated tobacco products,please report the incident directly to the local Health Bureau.Thank you for helping us maintain a healthy, safe, and smoke-free campus.
